These Terms of Service ("Terms") govern your use of the SparkKing mobile application ("App") operated by AEYEON Technologies Private Limited ("Company", "we", "our", "us").

By downloading, installing, or using SparkKing, you agree to be bound by these Terms.

1. Description of Service

SparkKing is a language learning application supporting 11 Indian languages: Kannada, Hindi, Tamil, Telugu, Malayalam, Marathi, Bengali, Gujarati, Punjabi, Odia, and Nepali.

2. Account Registration

• You must provide accurate information during registration
• You are responsible for maintaining account security
• You must be at least 13 years old (or have parental consent)
• One account per person

3. Subscription Plans

Free Plan:

• Limited lessons and practice sessions
• 5 pronunciations per day
• Basic features

Paid Plans (Basic, Premium, Pro, Pro+):

• Enhanced features and higher usage limits
• Billed monthly or annually
• Prices displayed in INR for India, USD for other regions
• All prices are inclusive of applicable taxes

4. Billing and Payments

• Payments processed securely via Apple App Store or Google Play Store
• Subscriptions auto-renew unless cancelled before renewal date
• You authorize recurring charges to your payment method

5. Cancellation and Refunds

• Cancel anytime through the App or respective app store
• Cancellation takes effect at the end of current billing period
• No refunds for partial billing periods
• Refund requests within 7 days of purchase may be considered on a case-by-case basis

6. Usage Limits

Each plan has daily limits on:

• AI chat sessions
• Pronunciation practice
• Conversation practice
• Shadowing practice

Limits reset daily at midnight IST.

7. Acceptable Use

You agree NOT to:

• Share your account credentials with others
• Attempt to bypass usage limits or security measures
• Use the service for illegal or unauthorized purposes
• Reverse engineer, decompile, or modify the App
• Use automated tools to access the service
• Upload malicious content or interfere with the App

8. Intellectual Property

All content, lessons, audio, graphics, and materials in SparkKing are owned by AEYEON Technologies Private Limited or its licensors. You may not copy, distribute, modify, or create derivative works without written permission.

9. User Content

Any feedback, suggestions, or improvements you provide may be used by us without obligation to you.

10. Disclaimer of Warranties

SparkKing is provided "as is" and "as available". We do not guarantee:

• Uninterrupted or error-free service
• Specific learning outcomes or fluency levels
• Compatibility with all devices

11. Limitation of Liability

To the maximum extent permitted by law, AEYEON Technologies Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

12. Indemnification

You agree to indemnify and hold harmless AEYEON Technologies Private Limited from any claims, damages, or expenses arising from your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka.

14. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
